1. Acceptance of These Terms

By accessing or using this website (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site. These Terms apply to all visitors, including people who browse content, download learning resources, or submit registration and contact forms.

You must be at least 16 years old to use the Site. If you are under 16, you may only use the Site with the involvement and supervision of a parent or legal guardian, who must also accept these Terms on your behalf.

2. Educational Scope and Disclaimers

PSF B.V. is an independent online education organization providing professional learning programs focused on business operations, workplace organization, project coordination concepts, process improvement, communication, leadership, and professional development. All services and resources offered through the Site are provided exclusively for educational and informational purposes.

PSF B.V. does not provide business consulting, operational consulting, financial advisory services, accounting, legal services, project management consulting, or investment services. Any examples, templates, or learning exercises are intended to support skills practice. They are not professional advice and should not be treated as guidance tailored to a specific organization, financial situation, or legal matter.

Participation in educational programs does not guarantee employment, promotions, salary increases, certifications, business success, or financial outcomes. Outcomes depend on many factors outside the control of PSF B.V., including how and where learning is applied.

3. Service Description and Availability

The Site provides information about courses, workshops, learning resources, and online registration options. Educational delivery is online. Program formats may include instructor-led sessions, self-paced modules, virtual workshops, webinars, and downloadable resources. Availability may vary by cohort schedule, instructor capacity, and content update cycles.

We may modify, suspend, or discontinue any part of the Site or educational offerings at any time. We aim to keep program descriptions accurate and current, but we do not guarantee that all information on the Site is error-free, complete, or continuously available.

Registration through the Site is a request for follow-up and enrollment support. Unless explicitly confirmed by PSF B.V. in writing, submission of a form does not create a binding agreement to deliver a specific program on a specific date.

4. Acceptable Use

You agree to use the Site lawfully and in a way that does not harm PSF B.V., other users, or the integrity of the Site. In particular, you must not:

• Attempt to gain unauthorized access to any systems, accounts, or data.
• Bypass or attempt to bypass security features, rate limits, or access controls.
• Use automated scraping, crawling, or harvesting of content, forms, or email addresses without our permission.
• Introduce malware, phishing attempts, or other harmful code, or upload content designed to disrupt service.
• Impersonate another person or misrepresent your identity or affiliation.
• Submit false, misleading, or unlawful information via forms.
• Use the Site to send spam or unsolicited communications.

We may suspend or block access to the Site if we reasonably believe usage violates these Terms or presents security or misuse risks.

5. Intellectual Property

The Site and its contents, including text, course descriptions, lesson outlines, templates, worksheets, downloadable resources, graphics, design elements, and the underlying code, are owned by or licensed to PSF B.V. and are protected by intellectual property laws.

Subject to your compliance with these Terms, PSF B.V. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial learning purposes. You may not copy, reproduce, distribute, publicly display, sell, resell, or create derivative works from Site content without prior written permission, except where a resource is clearly labeled for reuse in accordance with stated terms.

“PSF” and related names and branding are trademarks or trade names of PSF B.V. Use of our trademarks without permission is prohibited.

To the maximum extent permitted by applicable law, PSF B.V. disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Educational materials may include examples, frameworks, or templates (such as process maps, role clarity outlines, checklists, or communication routines). These are general educational artifacts and may not be suitable for every context. You are responsible for assessing appropriateness and for any decisions or actions taken based on educational content.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PSF B.V. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Site or educational content.

To the extent PSF B.V. is found liable for any claim, our total liability will be limited to the greater of (a) the amount you paid to PSF B.V. in the 12 months preceding the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits or excludes liability for matters that cannot be limited or excluded under applicable law, including liability for intentional misconduct or gross negligence where such limitation is prohibited.

9. Indemnification

You agree to indemnify, defend, and hold harmless PSF B.V. from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) information you submit through forms, (c) your violation of these Terms, or (d) your infringement of any rights of another person or entity.

10. Force Majeure

PSF B.V. will not be liable for any failure or delay in performance caused by events beyond reasonable control, including natural disasters, acts of government, war, labor disputes, pandemics, power failures, internet or telecommunications outages, cyberattacks, or failures of hosting or cloud service providers.

11. International Use

PSF B.V. is established in the Netherlands and provides online education for learners throughout Canada. Access to the Site from other locations is permitted only where lawful. You are responsible for compliance with local laws that apply to your access and use of the Site.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes arising out of or relating to these Terms or the Site will be submitted to the competent courts in the Netherlands, unless mandatory consumer protection laws provide you with rights to bring proceedings in a different jurisdiction.

If you are a consumer resident in the European Union, nothing in these Terms affects your rights under applicable consumer protection laws, including any rights to bring a claim in the courts of your country of residence where such rights are mandatory.

13. Dispute Resolution (Informal First)

Before starting formal proceedings, you agree to contact us and describe the issue so we can attempt to resolve it informally. Unless the matter requires urgent relief, please allow 30 days for informal resolution from the date you notify us.

14. Termination

We may suspend or terminate your access to the Site at any time if you violate these Terms, attempt to compromise Site security, or misuse the registration forms. The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and any provisions that by their nature should survive.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and PSF B.V. regarding your use of the Site and supersede any prior or contemporaneous understandings on that subject.

17. Assignment

PSF B.V. may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

18. No Waiver

If PSF B.V. does not enforce a provision of these Terms, that does not waive our right to enforce it later. Any waiver must be in writing to be effective.

19. Modifications to These Terms

We may update these Terms from time to time. Changes are effective 14 days after posting on this page, unless a change must take effect sooner to comply with legal requirements or address security issues. The “Last Updated” date at the top of the page reflects the most recent revision.

20. Electronic Communications

You agree that communications and notices related to the Site may be provided electronically. Submitting forms and clicking consent checkboxes (where applicable) constitutes an electronic signature. Where required, electronic signatures and electronic records are intended to have the same legal effect as written signatures and paper records.
